These Terms of Service ("Terms") govern your use of samwen.com, its subdomains, and any apps, games, tools, or other services that link to these Terms (collectively, the "Services"), which are operated by Sam Wen ("I", "me", or "my"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Eligibility

You must be at least 13 years old to use the Services. If you are under the age of majority where you live, you may use the Services only with the permission of a parent or legal guardian who agrees to these Terms.

Accounts

Some Services may let you create an account. You are responsible for the information you provide, for keeping your credentials secure, and for all activity under your account. Let me know right away if you believe your account has been used without your permission.

If you send me ideas, suggestions, or other feedback, I may use it without any obligation to you.

I DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY INFORMATION THEY PROVIDE IS ACCURATE OR COMPLETE. ANY TOOLS OR CALCULATORS ARE FOR INFORMATIONAL PURPOSES ONLY AND ARE NOT FINANCIAL, TAX, LEGAL, OR OTHER PROFESSIONAL ADVICE.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, I WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. MY TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID ME FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM OR US $50. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.

Indemnification

You agree to indemnify and hold me harmless from any claims, damages, losses, and expenses, including reasonable attorneys' fees, arising out of your use of the Services, your content, or your violation of these Terms.

Governing law

These Terms are governed by the laws of the United States and of the state in which I reside, without regard to conflict-of-law principles. Any dispute arising out of these Terms or the Services will be resolved in the state or federal courts located there, and you consent to their jurisdiction.

General

These Terms, together with any additional terms for a specific Service, are the entire agreement between you and me regarding the Services. If any provision is found unenforceable, the rest will remain in effect. My failure to enforce a provision is not a waiver of it. You may not assign these Terms without my consent; I may assign them without restriction.

Changes to these Terms

I may update these Terms from time to time. When I do, I will revise the "Last updated" date above. Your continued use of the Services after a change means you accept the updated Terms.
